Can you obtain a Long-Term Resident visa even with 5 traffic violations? Key points to avoid denial

Many foreign residents in Japan worry whether they can obtain or renew a Long-Term Resident status even if they have as many as five traffic violations in the past.
Although five violations do not automatically lead to denial, the content, timing, and seriousness of the violations, as well as your overall lifestyle, can significantly affect the examination, so careful preparation is essential.

This article explains, based on official information from the Immigration Services Agency of Japan and the Ministry of Justice, how traffic violations are evaluated in Long-Term Resident applications and what you can do to reduce the risk of non-approval.

According to the Immigration Services Agency, the status of residence “Long-Term Resident” is for a foreign national “authorized to reside in Japan with a designated period of stay, in light of special circumstances, by permission of the Minister of Justice.”
Typical examples include third-generation Japanese descendants, certain war-displaced Japanese and their family members, and resettled refugees, and the requirements depend heavily on each person’s individual situation.

Applications for change or extension of the Long-Term Resident status are examined under the “Guidelines for Permission for Change of Status of Residence and Extension of Period of Stay,” and are granted only when there are “reasonable grounds” for permission.
In assessing these grounds, immigration authorities consider not only family and financial situations but also good behavior and compliance with laws and regulations.

The official guidelines state that law-abiding behavior, administrative sanctions, and traffic violations are taken into account when examining change or extension of status of residence.
Multiple or serious violations may be considered as evidence that the applicant does not have good conduct, which can be a negative factor in deciding whether to grant a Long-Term Resident status.

In the application forms for Certificate of Eligibility and for extension of period of stay, there is a section titled “Criminal record (in Japan / overseas) ※ Including dispositions due to traffic violations, etc.” showing that traffic violations are explicitly included in the scope of examination.

There is no legal rule or guideline that automatically denies an application solely because there have been five traffic violations.
However, in practice, frequent violations in the past several years tend to be regarded as poor conduct, and some practitioners even mention that five or more traffic tickets in the last five years can be a serious disadvantage for permanent residence examinations.

For Long-Term Resident status, the examination is generally more flexible than for Permanent Resident, but the same factors such as “repeated” and “recent” violations are still important.
Therefore, it makes a big difference whether the five violations occurred long ago or are concentrated in the last two to three years.

The content and seriousness of each violation also matter.
Repeated minor traffic tickets (blue tickets) are treated differently from serious criminal traffic offenses involving fines, license suspension, or traffic accidents, which can carry greater weight in the examination.

  1. Organize and accurately declare your violation history
    Application forms clearly state that dispositions for traffic violations must also be declared, and any attempt to hide past violations can seriously damage credibility and raise the risk of denial.
    Before applying, you should organize the dates, types, and dispositions (traffic ticket, fine, suspension, etc.) of your past violations so you can provide a consistent explanation if asked.
  2. Check “when” and “what kind” of violations occurred
    When assessing risk, immigration authorities will focus on whether the violations are recent, whether they are minor or serious, and whether there has been a pattern of repeated offenses.
    Violations such as drunk driving, driving without a license, hit-and-run, or extreme speeding will be treated very negatively and can carry more weight than the mere number of five violations.
  3. Improve your overall lifestyle and tax/insurance records
    Examinations for Long-Term Resident status are holistic; your status is not decided by traffic violations alone.
    Stable employment, sufficient income, proper payment of taxes and social insurance, and a settled family life in Japan can all work as positive factors balancing the negative points of traffic violations.
  4. Show genuine remorse and preventive measures
    For applicants with multiple violations, demonstrating clear remorse and concrete measures to prevent recurrence can greatly influence how immigration officers perceive your case.
    Explaining why the violations occurred, how promptly you paid fines, what steps you have taken to improve your driving, and how long you have been violation-free will all be important elements.

Even with five traffic violations, it may still be possible to obtain, change, or renew a Long-Term Resident status if, for example, most violations were minor, no serious accidents occurred, your recent driving record has been clean, and your overall life situation in Japan is stable.
On the other hand, if the five violations include serious offenses such as drunk driving or hit-and-run, or if there have been repeated violations in the last few years, the risk of denial will become significantly higher.

As a result, applications should never be judged based only on the number of violations; instead, the content, timing, and your current lifestyle need to be considered as a whole.
