Is “Spouse of Japanese National” Status Obtainable Before Living Together? Legal Points for Applications Right After Marriage Registration

To live in Japan as the foreign spouse of a Japanese national, obtaining the “Spouse or Child of Japanese National” status of residence is essential. However, couples may not always be living together immediately after submitting the marriage registration. Is it possible to apply for a spouse visa before living together? This article explains key points, the role of cohabitation, and how to provide supporting documents, based on official information from government sources.

This status applies to foreign nationals who have a legal marriage with a Japanese citizen, or who are children (including special adoptees) of Japanese citizens. Importantly, formal marriage alone does not guarantee approval; the immigration authority seeks proof that the marital relationship is genuine, in order to prevent fraudulent marriages.

It is possible to apply for the “Spouse or Child of Japanese National” status after marriage registration, even if you are not yet living together. However, the Immigration Services Agency (ISA) emphasizes proof of “real marital life,” and cohabitation is a major point of review.

Article 752 of Japan’s Civil Code states that “Husband and wife must live together, cooperate, and assist each other”. Even if the marriage is legally registered, it is not enough. Applicants must provide evidence such as photographs, communication records, and housing contracts to substantiate that their relationship is actual and ongoing.

  • If there is no cohabitation, you must carefully explain your circumstances (e.g., work, moving arrangements) in a written statement.
  • For future cohabitation, submit housing contracts, a Certificate of Residence (Juminhyo), and a plan for living in Japan.
  • Supplement your application with communication records, photos, and plans for daily marital life to prove authenticity.

Suppose “A” (overseas) registers marriage with “B” (in Japan), but B is working and A cannot immediately relocate. If evidence such as flight bookings, housing contracts, and daily communication are provided, approval is possible. However, prolonged separation can raise doubts about the marriage’s authenticity, resulting in stricter review.​​

You can apply for the “Spouse or Child of Japanese National” status even before living together, but it is vital to show proof of a real marital relationship. Clearly explain your circumstances, submit supporting documents of future cohabitation and daily interaction, and regularly check official government sources for the latest information.
