Does Having Multiple Divorce Records Affect the Acquisition or Renewal of Specified Skilled Worker Status?

Some people wonder if having multiple divorce records affects the acquisition or renewal of the Specified Skilled Worker (SSW) status in Japan. With the increasing number of foreign workers and diverse lifestyles in Japan, this question arises more frequently. This article explains, based on the latest official information, whether divorce history has any impact on SSW status application or renewal.

The Specified Skilled Worker is a residency status established to allow foreign nationals with immediate skills to work in sectors facing severe labor shortages. For SSW (i), residence is permitted for up to five years and accompanying family is not generally allowed. For SSW (ii), there are no limits on renewal, and family members (spouse and children) can accompany if requirements are met.

Key examination points for acquisition and renewal are the applicant’s skill level, Japanese ability, the appropriateness of the receiving institution, and fulfillment of public duties (e.g., taxes, insurance).

Currently, divorce records or the number of divorces does not directly disqualify or disadvantage applicants for SSW status. Factors such as nationality, family structure, or marital history are important for “Spouse of Japanese National” or “Spouse of Permanent Resident” status, but for SSW the focus is on skills and work situation.

However, if divorce history has led to the nonpayment of taxes, social insurance, or child support, affecting public obligation records, this can influence SSW application or renewal. In rare cases involving a criminal record (e.g., domestic violence), it may impact the “good behavior” requirement, but ordinary divorce itself is not grounds for denial.

For both SSW (i) and (ii), documents about the applicant’s family are for confirmation purposes only. Details on the number or reasons for divorces are not required. For SSW (ii), when family members are to accompany the applicant, relationship and family status documents are needed. However, past divorce records themselves do not directly impact examination.

  • If the applicant has changed status from “Spouse of Japanese National” directly to SSW after divorce, and if there is a suspicion of a “sham marriage or divorce,” screening may be stricter.
  • If the applicant’s repeated divorces are linked to unacceptable social behavior or lack of genuine residence, this could potentially affect all types of residency status.

For example, even if Mr. A has been divorced twice, SSW acquisition or renewal is generally unaffected if he passes the skill and language tests, fulfills tax and insurance duties, and does not have a criminal record. However, if there is reason to suspect misuse of the marital status system for residency or any public obligation lapse, screening may become stricter.

As of now, simply having multiple divorce records does not negatively affect the acquisition or renewal of SSW status. The decisive factors are skills, Japanese proficiency, employment, and the fulfillment of public obligations. Unless there are special circumstances, applicants need not worry about divorces alone.
