What to Do If You Can’t Renew Your Engineer/Specialist in Humanities/International Services Status of Residence Before the Expiry Date

For foreign nationals in Japan with the “Engineer/Specialist in Humanities/International Services” status of residence, managing your period of stay is crucial. Missing your renewal deadline or being unable to prepare your application in time can lead to the risk of overstaying, which carries serious consequences. This article explains, based on official information from the Immigration Services Agency of Japan, what to do if your period of stay is about to expire and your renewal application may not make it in time.

The “Engineer/Specialist in Humanities/International Services” status of residence is typically granted for 1, 3, or 5 years. You can apply for renewal from three months before the expiry date, and you must submit your application before the period of stay ends.
If you miss the deadline, you will be considered an illegal overstay, facing possible deportation and penalties, so early preparation is essential.

If you submit your renewal application right before the expiry date and the examination is not completed by the deadline, a “special period” is provided. You can legally stay in Japan until the earlier of the following dates:

  • The date your renewal is approved
  • Two months after your previous period of stay expired

During this special period, a “processing” stamp will be placed on the back of your residence card, and you can continue working and living under the same conditions. Note that this does not apply to those with a period of stay of 30 days or less.

If you fail to apply for renewal and your period of stay expires, go to your local Immigration Services office immediately. If only a few days have passed, you may still be able to renew by submitting a letter of explanation and additional documents, but this is not guaranteed.
Even one day over the expiry date is considered illegal stay, with penalties of up to three years’ imprisonment or a fine of up to three million yen, and possible deportation.

If you have overstayed, in addition to the usual application documents, you may need:

  • Certificate of employment
  • Letter from your employer explaining continued employment
  • Written explanation of why you missed the deadline

Other documents may be required depending on your situation.

Example: Ms. A (Chinese, 30s, IT engineer) was working in Japan with an “Engineer/Specialist in Humanities/International Services” status. She forgot about her expiry date due to her busy schedule and rushed to apply just before the deadline. Her application was accepted, and a “processing” stamp was placed on her residence card, allowing her to continue working while waiting for the result.
On the other hand, Mr. B (Vietnamese, 20s, interpreter) realized three days after the expiry date. He immediately went to Immigration, submitted a letter of explanation, and was allowed to renew after a strict warning. However, he was told that future infractions could lead to denial or deportation.

  • Managing your period of stay is your own responsibility. Do not rely on your company or colleagues.
  • If there are changes in your job duties or employer, or if your documents are incomplete, you may need to submit additional documents or explanations.
  • Early consultation and preparation are key. Using the support of an administrative scrivener (gyoseishoshi) can help prevent problems.

If you have the “Engineer/Specialist in Humanities/International Services” status, you can apply for renewal from three months before the expiry date. Even if you are unable to apply in time, the special period system allows you to remain legally for a certain period, but do not be complacent. If you do overstay, go to Immigration immediately and explain your situation.
